Marisa Ala is Of Counsel for Palumbo Lawyers. Ms. Ala regularly represents nationwide builders, general contractors and developers in the defense of complex construction defect litigation involving multi-family projects, single family homes and commercial sites, including traditional construction defect claims as well as structural and geotechnical movement, dezincification in yellow brass pipe fittings, product liability, mold (including related personal injury claims), toxic torts and environmental matters. She repeatedly achieves outstanding results for each of her clients in defense of first-party claims and she aggressively pursues every level of risk transfer available through her extensive knowledge of both contractual indemnification and pursuit of defense contribution from additional insuring carriers. Marisa’s breadth of insurance coverage experience, including commercial general liability, OCIP/CCIP wrap policies with complicated enrollment programs, and excess/umbrella policies, provides her with the ability to effectively analyze exposure to the client and likelihood of risk transfer in these complex claims.
Ms. Ala’s representation of her clients also extends to the preparation of community covenants, conditions and restrictions as well as enforceability of and compliance therewith; the defense of breach of contract and indemnification claims resulting from the sale of mortgage loans and resulting repurchase claims by banks and investors; litigation of fraud and misrepresentation claims and business torts; insurance coverage litigation associated with risk transfer efforts; premises liability; fire cause and origin investigations; and real estate matters.
Ms. Ala is regularly asked to speak at local and regional conferences in both Colorado and California on topics involving insurance coverage, wrap policies, indemnification obligations and other relevant industry topics.
Ms. Ala is the 2015-2017 Construction Law committee Chair of the Colorado Defense Lawyers Association. Ms. Ala has received professional recognition in 5280 magazine's Top Lawyers issue (2017); the Super Lawyers magazine (2015-2016) and Law Week Colorado’s “Barrister’s Best” construction defect lawyer for defendants (2014, 2015).
Ms. Ala received her Juris Doctorate from Pepperdine School of Law in 1998, and her undergraduate degree from Pepperdine University. She is licensed in Colorado (2007), California (1998), and Nevada (2003) where she is admitted to practice before all state and federal courts.
